Interstate Carrier — A company is an Interstate Carrier if any part of its operation transports property or passengers in support of interstate commerce,
i.e., the property or passengers cross state lines either before the company received them, while the company is transporting them, or after the company has transferred the property or passengers. The transportation of the property or passengers may include transport by plane, train, or boat in addition to the company’s commercial motor vehicle.
The company is also considered to be an Interstate Carrier if the property or passengers being transported will ever do ANY of the following:
· Cross State lines (including a place outside the United States)
· Move from the United States or a U.S. territory to a foreign country, or vice versa
· Have origination and destination points within a State, but pass through another State or foreign
country during transport
Intrastate Carrier— A company is an Intrastate Carrier if no part of its operation transports property or passengers across state lines or from the United States or U.S. territory to a foreign country, or vice versa.
i.e., the property or passengers never cross state lines either before the company received them, while the company is transporting them, or after the company has transferred the property or passengers. The transportation of the property or passengers may include transport by plane, train, or boat in addition to the company’s commercial motor vehicle.
A company is an Intrastate Carrier if its business operation meets ALL of the following criteria:
· Never crosses state lines (including a place outside the United States)
· Never moves from the United States or U.S. territory to a foreign country, or vice versa

Examples of an Interstate Carrier include:
If the origination and destination indicated on the bill of lading are not in the same state, then the shipment is interstate.
Interstate Commerce means trade, traffic, or transportation in the United States which is between a place in a state and a place outside of such state (including a place outside of the United States) or is between two places in a state through another state or place outside of the United States.
i.e., a shipment originates in California and is shipped via barge to Alaska. A carrier transporting the shipment to or from the port and to its final destination would be engaged in Interstate transport.
Examples of an Intrastate Carrier include:
If the origination and destination indicated on the bill of lading are in the same state, then the shipment is intrastate.
i.e., a shipment originates in Anchorage, AK where it is picked up and transported via truck to Fairbanks, AK. Because the shipment originates in AK and has a final destination of AK, and travels through no other states or countries the carrier would be engaged in Intrastate transport.
i.e., a tour bus company transporting passengers on tours of a city or area within their state would be engaged in Intrastate transport.
